Child Custody and Support Issues Can Be Complicated

New York courts follow the best interest of the children standard for child custody and support matters. The court weighs several factors when determining custody, and then bases its decision on the best interest of each child. The usual custody arrangement is joint legal custody, in which both parents have the authority to make decisions about a child’s education, religion and medical treatment. The court also designates one parent as the custodial parent, meaning the children live with that parent. The other parent is given visitation rights.
